Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Gahitwen Logistics mobile application and related services (the "Service"), operated by The Gahitwen LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Gahitwen Logistics is a platform that connects cargo owners with truck drivers and fleet owners for the transportation of goods. The Service includes:
- Booking creation with pickup/dropoff locations and cargo details
- Real-time GPS tracking of active deliveries
- Bid negotiation between cargo owners and drivers
- In-app chat messaging
- Automated payment processing
- Driver and fleet owner verification and approval workflow
- Fleet management for vehicle owners
- Region-based geofencing and dynamic pricing
3. User Accounts & Registration
You must create an account to use the Service. Registration requires phone number verification via WhatsApp OTP. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, current, and complete information during registration and keep your profile updated.
4. User Roles
- Customer: Books cargo transport services. No approval required.
- Driver: Independent driver with their own vehicle. Requires document submission and admin approval before operating.
- Fleet Owner: Owns multiple vehicles and manages contracted drivers. Requires document submission and admin approval.
- Contracted Driver: Driver operating under a fleet owner's vehicle. Approval status inherits from the fleet owner.
- Administrator: System admin with access to the admin portal for application review, region management, and platform oversight.
5. User Responsibilities
All users agree to:
- Provide truthful and accurate information in all interactions
- Not misuse the platform for illegal, fraudulent, or harmful purposes
- Respect the privacy and rights of other users
- Not attempt to bypass platform fees or arrange off-platform transactions
- Comply with all applicable local, national, and international laws
Cargo owners additionally agree to:
- Accurately describe cargo type, weight, dimensions, and any special handling requirements
- Ensure cargo is legal to transport and properly packaged
- Be present or have a representative at pickup and delivery locations
Drivers and fleet owners additionally agree to:
- Hold valid licenses, permits, and insurance as required by local regulations
- Upload genuine, unaltered documents during the verification process
- Maintain vehicles in safe, roadworthy condition
- Operate within their approved service areas
- Share accurate real-time location data during active deliveries
6. Payments & Fees
Pricing is calculated based on region-specific configurations (base rate + distance × rate per km). Trip types are automatically detected as town, inter-regional, or cross-border. The platform may charge a service fee on completed transactions. All payments are processed through secure third-party payment processors. Funds are held until delivery is confirmed by both parties.
7. Driver & Owner Approval Process
Drivers and fleet owners must submit required documents (driver's license, vehicle registration, permits, insurance) during registration. Applications are reviewed by system administrators. Possible outcomes: approved (full platform access), rejected (with stated reason), or suspended (temporary restriction). The Company reserves the right to reject or suspend any user at its sole discretion.
8. Prohibited Conduct
- Transporting illegal, hazardous, or prohibited goods
- Submitting false or fraudulent documents
- Harassing, threatening, or discriminating against other users
- Manipulating ratings, reviews, or the matching algorithm
- Reverse engineering, scraping, or unauthorized access to the platform
- Creating multiple accounts to circumvent restrictions
- Arranging off-platform transactions to avoid fees
9. Intellectual Property
The Service, including its branding, design, code, algorithms, and content, is the exclusive property of The Gahitwen LLC. You may not copy, modify, distribute, or create derivative works without express written permission.
10. Third-Party Services
The Service integrates with third-party platforms including:
- Supabase: database, storage, and real-time infrastructure. Subject to Supabase's Terms.
- Firebase (Google): push notifications via FCM. Subject to Firebase Terms.
- Google Maps: mapping, places, and directions. Subject to Google Maps Terms.
- WhatsApp OTP: phone verification. Subject to the provider's terms.
We are not responsible for the practices or content of third-party services.
11. Limitation of Liability
To the maximum extent permitted by law, The Gahitwen LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The Service is provided "as is" without warranties of any kind, express or implied. Our total liability for any claim shall not exceed the fees paid by you to the Company in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless The Gahitwen LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
13. Termination
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time via the Delete Profile form. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including payment obligations, limitation of liability, and indemnification) will survive.
14. Dispute Resolution
Any dispute arising from these Terms shall first be addressed through informal negotiation. If unresolved, disputes between users should be resolved through the platform's support channels. For disputes with the Company, binding arbitration shall be conducted in Delaware, USA, under the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to conflict of law principles.
16. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via in-app notification or email at least 30 days before they take effect. Continued use after changes constitutes acceptance.
